Alabama Public Records Law

Alabama's general public-records rule lives in Ala. Code § 36-12-40. The statute grants the right to inspect and copy public writings unless another statute closes them. Section 36-12-41 orders public officers to give certified copies once lawful fees are paid. Section 41-13-1 defines public records broadly to cover written, typed, printed, or imaged documents made or received in public business.

Court records follow extra rules. Alabama Rule of Judicial Administration 33 sets case-record access. The Alabama Rules of Court-Record Privacy and Confidentiality took effect on January 1, 2025. The Alabama Judicial System public access page hosts those rules and lists the State Law Library's research tools.

Court Records vs County Agency Records

Madison County separates court records from agency records. The Circuit Clerk holds Circuit and District Court files. The Probate Judge holds wills, estates, marriages, deeds, and many recorded documents. The Sheriff holds jail booking, warrant, and incident records. Other county agencies hold permits, tax assessments, contracts, and meeting minutes. The right office handles the right kind of request.

How to File a Madison County Public Records Request

There is no single statewide public-records form in Alabama. Each office sets its own intake. For court records, use the Circuit Clerk's Records Request form. For probate and recorded documents, email the Probate office or visit in person. For Sheriff records that are not on the public roster, contact the Sheriff's office directly. Build your request around the four W's: who you are, what record you want, when it was created, and where it was created.

  1. Identify the office that holds the record.
  2. Write a short, dated request that names the record by date, parties, or case number.
  3. Include a daytime phone number and a return mailing address.
  4. Pay any applicable fee in the office's preferred form.
  5. Save the request and any response for follow-up.
  6. If denied, ask the office to state the statutory basis for the denial in writing.

Records That Are Confidential by Statute

Several categories sit outside ordinary public access. Juvenile case files are confidential under Ala. Code § 12-15-133. Adoption files seal after final decree under § 26-10A-31. Mental-health commitments are limited by § 22-52-10.4. Sealed and expunged criminal records under Title 15, Chapter 27 are not visible to the general public.

Other limits include grand jury secrecy, victim and witness identifying details, sealed exhibits, and certain personnel actions. Federal privacy law also limits medical and educational details under HIPAA and FERPA. The Alabama Rules of Court-Record Privacy and Confidentiality require redaction of Social Security numbers, financial account numbers, and similar identifiers. Public-facing remote access through AlaCourt remains a paid service, while in-person inspection at the courthouse is the closest free option for casual research.

The Madison County Circuit Clerk

The Madison County Circuit Clerk is Debra Kizer. The official page describes the Circuit Clerk as the official record keeper and business manager for District and Circuit Court proceedings. The office maintains court records, collects and disburses court funds, files pleadings, collects fines and fees, prepares subpoenas, issues court notices for trials and hearings, and manages jury duties. Records are kept in ten divisions including Civil, Criminal, Domestic, Child Support, Traffic, Juvenile, and Warrants. Records are electronically imaged.

Most public-record queries that touch a court case run through this office. Some queries cross over to Probate or the Sheriff. The Circuit Clerk's mailing address pairs the office name with a record type: family or domestic requests go to the Family Court Division, and District Court requests go to the District Court Division, both at 100 North Side Square.

The Madison County Circuit Clerk page names Debra Kizer and explains the office's records duties.

If a Madison County Public Records Request Is Denied

Alabama does not have a single state agency that resolves public-records appeals like some other states. If an office denies a request, ask for the legal basis in writing. Court records often require a motion before the judge in the underlying case rather than an ordinary agency appeal. For agency denials, you may need to ask a circuit court for relief. The Attorney General publishes general guidance, and the Alabama Press Association tracks public-records issues for the press community.

Note: Talk with a lawyer before filing a public-records suit; the right court and the right motion depend on whether the record is a court file or an agency file.
